Alterations in the Structure and Functioning of Pharmaceutical Storage Units within the Medical Field

In a significant step towards modernizing the healthcare sector, Romania has introduced Government Ordinance no. 9/2025. This ordinance offers medical practitioners more freedom to organize themselves and collaborate with other medical offices or cabinets, without any restrictive or mandatory hierarchical structures.

Under this new regulation, individual medical practitioners can form various types of medical practices, such as group practices, associations, or collaborative networks. This move is intended to enhance efficiency and coordination of patient care.

The ordinance maintains the medical practitioners' right to practice medicine independently while fostering collaborative practices without imposed structural constraints. This approach aligns with broader health system modernization trends focused on integrated and patient-centered care delivery.

Every medical cabinet must be registered in the Registry of Medical Cabinets held by Public Health Departments. The founding document is the registration certificate, which is issued in two copies: one for the issuing authority and one for the owner of the cabinet.

Each member of a joint venture is entitled to a share in the profits and losses of one or more operations they jointly undertake. The main obligation of the partners to a joint venture is to contribute with assets, money, specific knowledge, or other services related to their medical activity.

Medical cabinets are required to prove the minimum equipment set by specific provisions and display the schedule of activities along with the specific services provided, in a visible place. They must also periodically prepare reports containing statistical indicators and submit them to the Public Health Department.

It is worth noting that the new regulation does not limit the medical practitioner's right to practice by forming groups or in association with other medical cabinets. The forms established under the previous regulation remain in effect for medical cabinets without legal personality.

Operating a medical cabinet without this registration certificate is penalized by a fine ranging from 20,000 lei to 40,000 lei. The new regulation, which came into effect on March 5, 2025, also allows a medical office with legal status to take the form of a company, NGO, medical cabinet under religious organizations, or sports medicine cabinet.

This quantum marks a significant step forward in the modernization of the Romanian healthcare sector, providing medical practitioners with more flexible collaboration options while maintaining the integrity of the profession. As more precise legal texts or official summaries become available after August 2025, they would provide detailed provisions about the organization models introduced and any regulatory impact on practitioners' rights to practice and cooperate.
