A Tale of Molestation in the Heart of Turin
Starting her career at a downtown café, a 20-year-old girl faced an unexpected battle. "With my first job on the line, I chose to bear the brunt of his advances rather than shatter my parents' dreams. I didn't want to tarnish their pride. He spewed vulgarities, groped me, and made lewd proposals. I demanded him to cease, but his partner, the manager, terminated my employment."
The saga of a fleeting ordeal, spanning mere months, of workplace molestation received its due justice with a verdict of one year and five months' imprisonment handed down by the Fourth Criminal Court.
More recently, Turin's Court of Appeal upheld the verdict. The defendant, ably represented by lawyer Andrea Giordana, can only challenge the decision at Italy's Supreme Court, should the defendant opt for such a course. The lawyer had campaigned for his client's acquittal.
However, the judges viewed the victim as "truthful and reliable." The owner of the eatery, it was found, "coerced, repeatedly, and with violence the new hire to endure inappropriate acts," he "violated her personal space" and subjected her to verbal abuse.
The incident dates back two years. During the investigation and the trial, the victim encapsulated her experience as follows: "I stumbled upon the job listing on Facebook. The owner recruited me without a contract. The interview took place at his café. I worked alongside his partner, preparing sandwiches. And then I cleaned. After a week of work, he began to harass me during breaks when we were alone. Our conversations were always of an explicit nature. He detailed what he desired from me, suggesting I associate with older men over younger ones. He expressed a desire to "shatter the world" with a younger lover. Following the verbal humiliation, groping and touching ensued. *While I was washing dishes or at the stove, he would cling to me and touch me. I asked him to change his mannerisms, stating that a boss shouldn't behave so intimately with an employee. I was terrified of losing my job because it was my first one. I felt ashamed."
The harassment escalated. So, the 20-year-old confides in a friend, who advises her to speak to the owner's partner. She is terminated.
At this point, the girl, devastated, confides in her parents. The following day, her father and boyfriend stormed the café, threatening the owner, narrowly missing a physical altercation, mediated by the carabinieri. However, the incident, the judges explain, cannot excuse the defendant, who alleged: "I had grown fond of this girl and treated her as a daughter. She misunderstood the affectionate banter I shared with customers." In the judges' eyes, these were not innocent jokes, but reprehensible behaviors deserving of a fitting punishment, in his case one year and five months behind bars. The defendant will also be required to compensate the victim.
