The U.S. Environmental Protection Agency (EPA) has seen a change in its enforcement actions in Louisiana, following a permanent injunction issued by the U.S. District Court for the Western District of Louisiana on August 22, 2024. The injunction prevents the EPA from imposing or enforcing any disparate-impact or cumulative-impact-analysis requirements under Title VI of the Civil Rights Act of 1964 in the state of Louisiana.

Title VI, as amended, prohibits recipients of federal financial assistance from discriminating on the basis of race, color, or national origin in their programs or activities. The full text of Title VI can be found at 42 U.S.C. §2000d to 2000d-7. The EPA itself is responsible for the enforcement and monitoring of Title VI within its environmental programs, as per the agency's Title VI implementing regulation, which is found at 40 C.F.R. Part 7.

Under EPA's Title VI implementing regulation, EPA-funded agencies are prohibited from taking actions, including permitting actions, that are intentionally discriminatory or have a discriminatory effect based on race, color, or national origin. This regulation also extends to enforcing other external federal civil rights statutes.

It's important to note that this injunction only applies to Louisiana and Title VI, not to any other states or federal regulations. For instance, the Age Discrimination Act of 1975, which prohibits discrimination on the basis of age in federally-assisted programs or activities, is still in effect. Similarly, Section 504 of the Rehabilitation Act of 1973, which prohibits discrimination on the basis of disabilities, and Title IX of the Education Act Amendments of 1972, which prohibits discrimination on the basis of sex in federally-assisted education programs or activities, remain unaffected.

Title IX and Section 13 of the Federal Water Pollution Control Act Amendments of 1972, which prohibits discrimination on the basis of sex in programs or activities receiving financial assistance, can be found in their respective federal statutes. Complaints related to Title VI discrimination can be filed with the federal agency providing the financial assistance.

The EPA's Office of External Civil Rights Compliance (OECRC) is responsible for enforcing Title VI, ensuring that the agency's programs and activities are free from discrimination. The OECRC also enforces other external federal civil rights statutes, such as Section 504 of the Rehabilitation Act of 1973, Title IX of the Education Act Amendments of 1972, and the Age Discrimination Act of 1975.

This injunction has immediate effects on EPA's enforcement actions in Louisiana, but it does not affect the EPA's commitment to ensuring equal opportunities in its programs and activities across the nation. The agency continues to work towards a cleaner and more equitable environment for all Americans.
