Hessen strengthens rights for parents of stillborn children - Hessen's New Burial Laws: More Time, Options, and Dignity for Angel Babies

Hessen has updated its burial laws, with the Hessian Cemetery and Funeral Act (HBuBGG) reform passing the state parliament in Wiesbaden on 6th October 2022 and coming into effect on 1st November 2023. The new regulations aim to provide more flexibility and support to families during difficult times.

The reform, which modernizes the 1963 law, introduces several changes. It extends the burial deadline, giving families more time to arrange funerals. Previously, burials had to occur within four days, but this has now been increased to a maximum of ten days, with a minimum of 48 hours after death. This change acknowledges that the loss of a loved one can be sudden, and families may need more time to organize a funeral, especially if they live further away.

Another significant change concerns angel babies, who are now granted a clear right to burial. Previously, babies weighing less than 500 grams and born before the 24th week of pregnancy did not have this right. The reform ensures that these tiny lives can be laid to rest with dignity. In cases of twin or multiple births, hospitals will be required to inform parents about this burial option.

The reform also introduces new options for burial, including the possibility of being laid to rest in a designated forest area, and the relaxation of the compulsory burial on a cemetery in certain circumstances.

The updated Hessian Cemetery and Funeral Act offers families more time and options for burying their loved ones. It also ensures that angel babies can be buried, providing comfort and closure to grieving parents. These changes reflect a more compassionate and flexible approach to end-of-life practices in Hessen.
