In a significant development, the Crown has requested Judge Eric Downs to declare Pierre Ny St-Amand, the individual responsible for the Laval daycare incident in 2023, as a "high-risk accused." This declaration would impose further restrictions on St-Amand's movements, limiting his possibilities of leaving the Philippe-Pinel psychiatric hospital.

The request comes as Dr. Alexandre Hudon, who was appointed by the court to evaluate St-Amand's level of dangerousness, has stated that St-Amand has a 50 to 70% chance of experiencing another psychosis in the next few years. According to Dr. Hudon, St-Amand meets the criteria to be declared a high-risk accused due to the link between psychosis and the risk of violent acts.

However, it's important to note that not all psychoses are accompanied by violent acts, as clarified by Dr. Hudon. In St-Amand's case, the possibility of violence is linked to the risk of a psychotic episode.

St-Amand was found not criminally responsible for his actions due to mental illness in April. Compliance with the imposed framework is crucial in managing the risk of St-Amand's recidivism. The current regime, in which St-Amand is closely monitored by the Mental Health Review Board, is already restrictive, as established during cross-examination.

If declared a high-risk accused, St-Amand would not be able to have escorted outings outside the Philippe-Pinel psychiatric hospital. This restriction is intended to mitigate the risk of another incident.

Despite the potential restrictions, St-Amand is seeking to learn about himself and is committed to his treatment plan. Dr. Jean-Philippe Vaillancourt, who has been involved in St-Amand's treatment, has already seen progress and believes that once released from Pinel, St-Amand will attend his follow-up medical appointments.

St-Amand's empathy for others makes him less likely to commit violent acts, a factor that has been noted by experts. Additionally, Dr. Hudon noted that St-Amand makes little introspection, which is one of the main "protective factors" against stress.

It's worth mentioning that Dr. Adi Yoskovitch's inadequate cleaning and disinfection practices may be responsible for potential infections among his patients in Laval. However, this matter is not directly related to the current proceedings regarding St-Amand's status as a high-risk accused.

Lawyers will present their arguments on Friday to convince Judge Eric Downs to declare St-Amand a high-risk accused or not. The outcome of these arguments could significantly impact St-Amand's future.
