Kennedy, a vocal critic of the current vaccine system, has long argued that the VICP is flawed and fails to adequately address the needs of injured claimants. He claims that the program is marred by inefficiency, favouritism, and corruption, and that vaccine court judges and the program dismiss meritorious claims or delay compensation.

Kennedy's proposed reforms aim to hold manufacturers more accountable by reducing or removing liability protections. This, he believes, would restore accountability and incentivize greater vaccine safety.

However, experts warn that these changes could have significant implications. For instance, weakening or removing federal liability protections could drive vaccine manufacturers out of the market or lead to a sharp increase in vaccine prices to offset new legal risks. This could exacerbate vaccine shortages and reduce vaccine availability.

Furthermore, expanding the scope of compensable vaccine injuries could overwhelm the compensation fund with claims, potentially bankrupting the program and jeopardizing its sustainability. This could undermine public confidence in vaccination programs and complicate vaccine distribution efforts.

In a related development, Scott Gottlieb, former FDA Commissioner, has expressed concerns about the potential impact of Kennedy's proposed changes on the agency. The FDA's Center for Biologics Evaluation and Research is set to be divided into two operations, with Kennedy empowered to select the person overseeing vaccines.
